For the purposes of being declared surplus to a secondary school, the following criteria shall be considered (i) the least number of years of experience of a teacher within the secondary school panel which shall be the length of time from the commencement of such teachers most recent employment in secondary schools/ workplaces the qualifications as registered on the teachers Certificate of Qualifications previous teaching experience in the available subject areas. In determining which of two or more teachers are to be declared surplus, the Board shall apply the criteria set out in (i), (ii) and (iii) in that order. In the event that two or more teachers are equal based on (i), (ii) and (iii) and neither volunteers to be declared surplus, the Board shall consider the relevant skills and competence of such teachers. What number of teachers needs to be declared surplus? If surplus is being declared to 2. above, what are the relevant skills and competence used as a rationale to declare the teacher(s) surplus Open or Unfilled positions Are there any open positions in the school If so, has it been advertised throughout the school board? Are there any unfilled positions due to teachers taking a leave of absence (e.g. over the summer) ? If so, how is it to be temporarily filled? Form 106-Section A Full utilization of teacher allocation Has the teacher allocation for the credit bearing sections been fully utilized? (Ed. Note: you should have been able to check this before the LSSAC meeting if you received the back up material at least 2 days in advance of the LSSAC meeting) Under-utilization in this area means that OTHER teachers must unduly bear larger class sizes. This is contrary to Article 6.01(d) of the collective agreement: It is the intent of the parties that the assignment of teaching load, class size, number of different class preparations, teaching time, supervision duties and other related assignments will be done in a fair and equitable manner for all teachers. (emphasis added) Are there any sections that have been utilized for non-existent positions such as School Attendance Counsellors, Computer Site Administrators, Activities Co-ordinator, etc.? Positions such as these are NOT funded by the Ministry of Education, and violate Article 6.01(d) of the Collective Agreement as well. Library Teachers assigned to library Is the teacher in charge of the library program have the qualifications as required under Regulation 298: ss. 19 (14)No teacher shall, (b) be placed in charge of, (i) a school library program, (ii) a guidance program, or (iii) special education; or unless, the teachers certificate of qualification indicates qualifications in the subject or program to which the teacher is to be assigned or appointed or placed in charge; [Ed. Note: notice the Regulation uses the word indicates which means the teacher already has the qualification. This definition would NOT include in the process of getting the qualification because the teachers certificate then would NOT indicate that s/he already has the qualification.] How it is staffed? Which teachers are in each of the 4 periods of the day for both semester 1 and semester 2? How is the school library being kept open for all of the periods of the day? Guidance Teachers assigned to Guidance Is the Department Head for Guidance properly qualified? (as per Reg. 298, ss. 19 (14); see above) Do all teachers of guidance that have more than 2 sections of guidance have the proper qualifications as per Reg. 298, s. 19: (14)No teacher shall, (a) be assigned, or appointed to teach, in any of grades 9, 10, 11 and 12 in any one school year for more than the time required for two courses that are recognized for credit in art, business studies, guidance including counselling, family studies, instrumental music, vocal music or physical education; or unless, (d) the teachers certificate of qualification indicates qualifications in the subject or program to which the teacher is to be assigned or appointed or placed in charge; Chaplaincy Teachers assigned to Chaplaincy Have all the sections allocated to Chaplaincy been assigned to teachers? What is the ratio of IEP/IPRC students-to-Special Education monitoring section for EACH teacher? Master Schedule All sections coded (including guidance, library, chaplaincy and special education) Have all sections been coded. If not, can a new Master Schedule be produced including the relevant coding.
